This Privacy Policy describes our policies and procedures on the collection, use, and disclosure of your information when you use the Service. It also explains your privacy rights and how the law protects you. By using the Service, you agree to the collection and use of information in accordance with this Privacy Policy.

1. Interpretation and Definitions

Account: A unique account created for you to access our Service.

Affiliate: Any entity that controls, is controlled by, or is under common control with the Company.

AI Provider: A third party that processes photos you submit in order to produce a result you requested.

Application: EverPixel software provided by EVERPIXEL YAZILIM ANONİM ŞİRKETİ.

Cloud Feature: A feature that requires a photo you select to be uploaded to our servers, as opposed to a feature that runs entirely on your Device.

Company: EVERPIXEL YAZILIM ANONİM ŞİRKETİ.

Country: Turkey.

Device: Any device capable of accessing the Service (e.g., computer, smartphone, tablet).

Personal Data: Any information relating to an identified or identifiable individual.

Service: The EverPixel Application.

Service Provider: Third parties processing data on behalf of the Company.

Usage Data: Data collected automatically, such as IP address, browser type, and page visits.

You: The user or entity accessing the Service.

2. Types of Data Collected

Personal Data:

Email address, first and last name, phone number, address, city, postal code.

Photos and Content You Select:

The specific photos you choose when using a Cloud Feature, and the edit settings you request. We do not access or scan your photo library, and we do not collect photos you have not selected for a specific operation.

Face Data:

Some features detect faces in the photos you select, for example to align an edit. On-device detection stays on your Device. If you use a Cloud Feature, the photo you selected — which may contain a face — is uploaded and processed as described in Section 3. We do not use face data for identification, do not build face templates, and do not sell face data.

Usage Data:

Collected automatically via Device or Service infrastructure, e.g., IP address, browser type, device ID, operating system, page visits, session duration.

3. Photos and AI Processing

What we process: Many features run entirely on your Device and send nothing anywhere. Cloud Features require the photo you selected to be uploaded and processed on our servers and by our AI Providers. Cloud Features include: photo enhancement, beautification, colorization, old photo restoration, background removal and replacement, avatar generation, face swap, age change, sky, clothing, eyewear and hairstyle edits, image expansion, AI relighting, and animation effects.

What is sent: Only the photo you selected, the edit settings you requested, and a randomly generated job identifier used to return the result to your Device. We do not send your name, email address, phone number, address, contacts, or photo library.

Who receives it: Photos are stored on infrastructure operated by Amazon Web Services, Inc. (United States) and are processed by AI Providers, including:

Google LLC (United States) — via the Gemini API, for most AI photo edits.

Amazon Web Services, Inc. (United States) — for storage, and for face swap and animation processing.

Each AI Provider is bound by a written data processing agreement requiring protections equivalent to those described in this Privacy Policy, and prohibiting any use of your photo for its own purposes.

Consent: We ask your permission inside the Application before the first upload, and we tell you what is sent and to whom. If you decline, Cloud Features are unavailable and all on-device features continue to work normally. You can withdraw your consent at any time in the Application's Settings.

Model training: Your photos are not used to train or improve our AI models or those of our AI Providers.

Retention: Uploaded photos and generated results are deleted from our servers within 3 days. Results you saved remain on your Device. Our AI Providers may retain a copy for a short period solely to monitor for abuse and to meet their own legal obligations, and may not use it for any other purpose.

4. Use of Personal Data

The Company may use your Personal Data to:

Provide and maintain the Service.

Process photos you submit through a Cloud Feature and return the result to your Device.

Manage your Account and registration.

Fulfill contractual obligations, including purchase agreements.

Communicate via email, SMS, or push notifications regarding updates, offers, or security information.

Analyze usage trends and improve the Service. We do not use photos you submit for this purpose.

Manage business transfers, mergers, or acquisitions.

Any other purposes with your consent.

5. Sharing of Personal Data

Your Personal Data may be shared:

With AI Providers, as described in Section 3, solely to produce the result you requested.

With Service Providers for support and analytics.

With Affiliates who are required to comply with this Privacy Policy.

With Business Partners for promotions or services.

With Other Users when interacting publicly within the Service.

During Business Transfers (merger, sale, or acquisition).

With Your Consent for other purposes.

6. Retention of Personal Data

Personal Data is retained only as long as necessary for the purposes stated.

Photos submitted through a Cloud Feature are deleted from our servers within 3 days, as stated in Section 3.

Records of processing requests are retained for up to 90 days for support and abuse prevention.

Usage Data may be retained for internal analysis, security, and Service improvement.

Data retention complies with legal obligations.

7. Transfer of Personal Data

Your data may be processed in locations outside your country, where data protection laws differ. This includes the AI Provider locations listed in Section 3.

We implement reasonable safeguards to ensure data security and compliance.

8. Legal Disclosures

We may disclose Personal Data to:

Comply with legal obligations or law enforcement requests.

Protect the Company’s rights or property.

Prevent fraud, misuse, or threats to public safety.

9. Security of Personal Data

While we use commercially reasonable measures to protect your data, no method of transmission or storage is 100% secure.

Photos uploaded for a Cloud Feature are transmitted over encrypted connections and stored in access-controlled storage for the limited period described in Section 3.

10. Children’s Privacy

Service is not intended for anyone under 13.

If a child under 13 provides Personal Data, we will remove it upon verification.

Parental consent is required where applicable.

11. Links to Other Websites

Our Service may contain links to third-party websites.

We are not responsible for the privacy practices of these external sites.

12. Your Rights

Depending on your jurisdiction, you may have the right to:

Access your Personal Data.

Correct or update your Personal Data.

Delete your Personal Data.

Restrict processing or object to processing.

Withdraw consent at any time, including consent to AI processing.

Data portability.

13. Refunds and Payment Integration

Your use of EverPixel is subject to our Refund Policy, [available here](/refund-policy/).

Data may be shared with Paddle for payment processing and refund handling.

14. Compliance with Laws and Ethics

You must use the Service ethically and legally, respecting third-party rights.

Deepfakes and media misuse are prohibited; violations may lead to account termination.

15. Changes to this Privacy Policy

We may update this Privacy Policy and will post the new version with an updated “Last Updated” date.

If a change materially affects how we handle your photos, including adding a new AI Provider, we will notify you in the Application and ask for your permission again before any further upload.
