1. License Grant
Apps made available through the App Store are licensed, not sold, to you. Your license to each App is subject to your acceptance of this Standard EULA or a Custom EULA provided by the Application Provider. The license for any Apple App is granted by Apple, while the license for any Third Party App is granted by the Application Provider.
You are granted a nontransferable license to use the Licensed Application on Apple-branded products you own, as permitted by the Usage Rules. You may not redistribute, transfer, or sublicense the Licensed Application, or copy, reverse-engineer, or create derivative works except as allowed by law or open-source licensing terms.
2. Use of Data
You consent that Licensor may collect technical data and related information about your device, system, and application usage to provide updates, support, and services. This technical data is used in anonymized form to improve products and services.
Photos and other content you select are not technical data and are not covered by this section. They are handled only as described in Section 3 and in our Privacy Policy. We do not use your photos to improve our products or services, and we do not use them to train or improve any AI model, whether ours or an AI provider's.
3. Your Content and AI Processing
You retain all rights to the photos and content you select. You grant Licensor a limited, non-exclusive licence to process a photo you select solely to produce the edit you requested and return it to you. This licence ends when the photo is deleted from our servers.
Some features run entirely on your device. Features that cannot run on your device ("Cloud Features") require the photo you selected to be uploaded to our servers and processed by third-party AI providers, including Google LLC (via the Gemini API) and Amazon Web Services, Inc., both in the United States. Each provider is bound by a written data processing agreement requiring protections equivalent to those in our Privacy Policy and prohibiting use of your photo for its own purposes, including model training.
We ask your permission in the application before the first such upload. If you decline, Cloud Features are unavailable and all on-device features continue to work. You may withdraw consent at any time in Settings. Uploaded photos and generated results are deleted from our servers within 3 days. You represent that you own or have the necessary rights to every photo you upload, and that you have the consent of any identifiable person depicted in it. Do not upload photos of other people without their permission.
4. Refunds and Payment
All purchases are processed via Paddle, our authorized payment processor. Refunds are handled according to our Refund Policy, [available here](/refund-policy/).
Key Points:
Refunds are available within 1 day of purchase if the product is not fully used or activated.
Subscription renewals may be refunded within 7 days of renewal if unused.
Unauthorized chargebacks may result in account suspension.
5. Termination
This EULA remains effective until terminated by either party. Your rights terminate automatically if you fail to comply with any terms herein. Licensor may also terminate access for ethical or legal violations.
6. External Services
The Licensed Application may provide access to third-party services (“External Services”). You use these at your own risk. Licensor is not responsible for content, accuracy, or availability of External Services.
This section concerns third-party services you choose to access. It does not apply to the AI providers described in Section 3, which process your photos on our behalf under written data processing agreements and for which we remain responsible.
7. Warranty Disclaimer
USE AT YOUR OWN RISK. The Licensed Application is provided “as is” and “as available.” Licensor disclaims all warranties, including merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions may not allow exclusion of warranties, which may limit this disclaimer.
8. Limitation of Liability
Licensor is not liable for incidental, special, or consequential damages, including loss of profits or data. Total liability shall not exceed $50, except as required by law in cases of personal injury.
9. Export Compliance
You may not export or re-export the Licensed Application in violation of U.S. law or local jurisdiction laws. This includes embargoed countries or persons on restricted lists.
10. Governing Law
This Agreement is governed by California law, excluding conflict-of-law provisions. EU/Switzerland/Norway/Iceland residents submit to the jurisdiction of their usual place of residence. The UN Convention on Contracts for the International Sale of Goods does not apply.
11. Prohibition of Deepfakes and Media Misuse
You may not use the Licensed Application to create or distribute deepfake content, manipulated media, or any content that violates rights, privacy, or dignity. You may not use the Licensed Application to depict any identifiable person without their consent.
12. Ethical Use and Legal Compliance
You must comply with all applicable ethical guidelines, laws, and community standards. Licensor may provide notices or best practices, which you agree to follow. You are responsible for respecting intellectual property, privacy, and data protection laws.
13. Privacy Integration
Your use of the Licensed Application is also subject to our [Privacy Policy](/privacy-policy/), which identifies what data we collect, how we collect it, all uses of that data, and every third party with whom it is shared. Personal data may be shared with payment processors such as Paddle, and photos you submit through a Cloud Feature are shared with the AI providers named in Section 3 of the Privacy Policy, each of which is contractually bound to equivalent protections.
